Terms of Service

1. Acceptance of Terms

By creating an account, logging in, or using EyeCreate Spaces (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms form a legally binding agreement between you and EyeCreate Spaces.

2. Eligibility

• You must be at least 13 years old to create an account (16+ in some regions).
• Users under 18 must use Kids mode with a linked parent account and parental consent.
• You must provide accurate account information and keep it updated.
• One person may not create accounts for others without authorization.

3. Your Account

• You are responsible for safeguarding your password and for all activity under your account.
• Notify us immediately of any unauthorized use or security breach.
• You may create multiple EcosystemProfiles (public identities) under one account, but each must comply with these Terms.
• Handles and display names that impersonate others may be reclaimed or removed.

4. User Content

You retain ownership of all content you create and publish on EyeCreate Spaces.

By publishing content, you grant EyeCreate a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your content within the Service for the purpose of operating the platform.

You represent that your content:

• Does not violate any law or third-party rights (copyright, trademark, privacy)
• Does not contain hate speech, harassment, threats, or graphic violence
• Does not sexualize minors or depict illegal acts
• Does not spread misinformation intended to deceive or harm
• Does not contain malware, spam, or malicious code

We may remove content that violates these Terms or our Community Guidelines, with or without notice.

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Harass, bully, stalk, or intimidate other users
• Impersonate another person or claim an identity you do not own
• Scrape, copy, or redistribute platform data without permission
• Attempt to disrupt, overload, or gain unauthorized access to the Service
• Circumvent content filters, safety systems, or rate limits
• Use bots or automation to inflate engagement or manipulate rankings

6. Fundraisers and Payments

• Fundraisers are created by profile owners and must represent legitimate causes.
• Donations are processed by Base44 Payments (Wix Payments). Chargebacks and fraud are prohibited.
• Fundraiser owners are responsible for accurate descriptions and proper use of funds.
• Active fundraisers with donations cannot be hard-deleted; they are canceled and donors notified.
• Completed fundraisers are retained for donor transparency and financial records.

7. EyePoints and Virtual Currency

• EyePoints are a virtual currency for use within EyeCreate Spaces and have no cash value unless redeemed through approved payout methods.
• Purchases of EyePoints are final and non-refundable except where required by law.
• Exploiting bugs or glitches to generate currency is prohibited and may result in account suspension.

8. Creator Studio and Camera Use

• The Creator Studio accesses your camera and microphone only with your active permission.
• You are responsible for ensuring you have rights to any media you upload or record.
• Recording others without consent is prohibited.

9. Identity Claims and Archive Content

• Unclaimed identities may be published by EyeCreate Archive for historical preservation.
• Users may submit Identity Claims to claim an identity they rightfully own. Approved claims transfer ownership.
• Users may submit Identity Removal Requests for impersonation or unauthorized use of their identity.
• EyeCreate reserves the right to approve or reject claims at its discretion.

10. Content Moderation

We moderate content to keep EyeCreate safe. We may remove content, suspend accounts, or ban users who violate these Terms or Community Guidelines. You may appeal moderation actions through the in-app appeal system.

11. Intellectual Property

The EyeCreate Spaces platform, including its design, bioluminescent visual identity, logos, and software, is owned by EyeCreate and protected by intellectual property laws. You may not copy, modify, or distribute platform materials without permission.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted, error-free, or secure operation. We are not liable for content posted by users or for any damages arising from your use of the Service to the extent permitted by law.

13. Limitation of Liability

To the maximum extent permitted by law, EyeCreate's total liability for any claim arising from the Service is limited to the amount you paid us in the past 12 months, or $50, whichever is greater. We are not liable for indirect, incidental, or consequential damages.

14. Termination

You may delete your account at any time via Settings → Reset My World. We may suspend or terminate your account if you violate these Terms. Upon termination, your content will be removed per our Data Deletion Instructions, except records retained for legal compliance.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification or email. Continued use after changes constitutes acceptance.

16. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where EyeCreate operates. Disputes will be resolved in the appropriate courts of that jurisdiction.
